Working for Online Casinos Too
The European Union has a pretty sticky situation on their hands in regards to
the debate about whether the online casinos are covered under the EU’s policies
of free trading between member-states of goods and services. The internet
gambling industry has steadily developed throughout Europe but yet there are
still a handful of member-states denying that gambling is included in the EU
policies. The online casinos actually have a pretty strong case though because
of the landmark decision several years ago concerning Stanleybet’s right to
operate land betting shops in Italy as a part of the EU policies. The European
Court of Justice upheld Stanleybet’s right to operate a gambling business under
the protection of the EU.
That 2003 European Court of Justice landmark Gambelli ruling has been used by
other land betting companies to similarly develop and flourish in other European
markets. The online casinos though are finding that most countries feel that the
internet gambling industry is a whole other beast and that the Gambelli ruling
does not actually set case precedence for the internet gambling. That means that
the online casino sites willing to take up the fight could be facing a decade
long battle with some countries just as Stanleybet has spent a decade forcing
the Italian government to recognize the company’s legal right to operate land
betting shops.
The online casinos are within a unique industry that is facing a lot of
challenges in Europe right now because the lack of clear rulings from the
European Court of Justice about whether the EU is truly an open market to
internet businesses as well as land based commerce. |
