Where Does Online Casino Gambling Occur?
A new debate has launched in the online casino gambling
industry that has no clear answer and has started some strong clashes in the
South African gambling market. South Africa technically still makes internet
gambling an illegal pastime in the country despite the fact that the South
African government gave preliminary approval of new licensing policies that
would fully legalize and regulate the online casinos in the country. Though
preliminary approval is in place, the activity is illegal right now and the
South African authorities are having a tricky time actually enforcing the law.
The banking system in South Africa has the brunt of the task, but land disputes
are also taking place because of a legal online gambling site operating out of
neighboring Swaziland.
Swaziland has allowed the online casinos to legally base servers out of the
country and operates the Piggs Peak gambling site, which fully accepts and
welcomes any and all South Africans that are interested in signing up for and
gambling on the site. Piggs Peak has long standing litigation in place with the
South African authorities because the online casino site claims that because the
servers for the site are based out of Swaziland that gambling on the site is not
actually illegal in South Africa. This is a sticky claim though and one that has
not held up in any other country world wide, but one that South Africa has had a
tough time negating.
The servers are based in Swaziland and the online casino is fully operating
outside of South Africa, so the authorities at Piggs Peak are adamant that they
are within their rights to offer internet gambling to the South African
population. Because the site is not actually within South Africa though, the
authorities have no jurisdiction to shut down the site’s operations. |
