No Go on French Online Casino Regs
The fate of French online casino gambling licensing lies up in the air right now
as the French government still plans to open the market to an extent, but the
European Union courts have ruled that France’s planned internet gambling
regulations are still non-compliant with the full scope of EU policies. France
previously ran a state gambling monopoly that excluded all non-French based
online casinos from legally accessing the market and certainly from competing in
the advertising space in the country. France has made a big show of opening up
the market over the past year with the development of a new set of regulations
that will fully license and regulate foreign companies for entry into the French
gambling market. The issue though lies in the fact that these new regulations
are still biased toward French listed gambling groups.
The European Union’s policies for the free trade of goods and services between
EU member states dictates that France’s market must give equal access, tax
breaks, and advertising opportunities to foreign online casinos and business as
well as the French based companies and this is where the French regulations
failed to pass through the EU court’s scrutiny. There are clear tax differences
for French based online casinos and foreign sites will still get the shaft in
terms of advertising their businesses in France.
For this precise reason the EU courts have ruled that the new French regulations
are not sufficient to bring the country into full compliance and still need
adjustments. Whether or not France plans to actually make these adjustments is a
whole other issue however. There is every indication that the French government
plans to go ahead with the current French online casino licensing plan despite
the EU’s opinion on non-compliance, which means that gaming sites may receive
licensing very soon. |
