How it All Went Down
The Betcha.com case is back in the online casino industry radar as the case goes
all the way to the Washington State Supreme Court this week and soon the SC will
hand down the final word in the case. The progression of the case has been going
on for quite some time and it all really started with the UIGEA and the national
federal ban on foreign online casinos operating in the market. As all of the
gambling sites began to exit the US market, there was an opening for a form of
internet gambling that was acceptable and legal that gamblers could enjoy
without either triggering the UIGEA ban, nor triggering the ban that the state
of Washington also has against internet gambling.
Nick Jenkins saw the opportunity in the market and, after consulting the
legality with experts in the online casino gambling industry, launched a betting
site that had no binding bets. The idea behind Betcha.com being that gamblers
can place wagers with other gamblers on just about anything under the sun…but
they have no legal and binding obligation to make good on the bets. In this way,
the site was quite different from online casinos and traditional betting sites
because there was no actual risk in placing the bet – therefore it’s not a true
gamble.
The Washington State officials did not seem to agree on the fine points of this
betting site and raided the facility, seized computers that were used to run the
online betting site, and arrested several employees, including Jenkins. The
lower courts sided with the State’s right to end the operations on the grounds
of illegal online casino betting. The State Appeals Court however sided with
Jenkins that the model was sound and did not resemble gambling. Now the third
and final verdict will stand as the Washington Supreme Court makes a ruling in
the case. |
