Sweden Clear?
The Swedish state gambling monopoly scored a major coup this week in the
attempts to legally continue operating the state’s land and online casino
gambling monopoly. Sweden has long been one of the key focuses for the European
Commission as an example of a nation that is not adhering to EU policies of free
trade between EU member states. Swedish government operates a state monopoly and
aggressively attempts to block foreign operators from practicing any form of
gambling in the country in competition with state gambling services. The
Commission has contended that Sweden is in the wrong and needs to open and allow
online casinos licensed in other EU states the ability to compete but the
highest court in the EU, the European Court of Justice, made a landmark ruling
that will strongly effect the EU internet gambling situation.
The case in question was brought before the European Court of Justice because
the Swedish government refused to allow foreign online casinos to advertise in
the nation’s newspapers. This case had the potential to really force Sweden to
open its doors to foreign competition but instead further supports the monopoly
by ruling that Sweden is able to block commercial advertisements in the country
if the reason for blocking the companies was done specifically with the public
interest in mind.
The European Commission seems to differ with the final rulings of the European
Court of Justice these last few months. It was been years since the Commission
began to force these nations to open their borders to foreign competition and
now the ECoJ is coming in and affirming that some of the EU policies might not
