Many Claims Pending Against Online Casinos
A US based communications companies is fishing for money right now as the small
telecommunications company just sued eleven online casinos for patent
infringement. The company in question, Lottotron Inc. claims that a very basic
technology that is used within the Real Time Gaming software is a patented
process that is owned by this communications company. This is, by far, not the
first case that Lottotron has filed against a major company. In fact, Lottotron
has previously filed similar a similar case against Microsoft! Additionally,
earlier this year the company attempted the same patent infringement claims
against another online casino, SBG – in all of these previous cases the courts
have thrown out the claims.
Lottotron continues to primarily target some of the largest companies and
businesses using this technology, particularly the online casinos. The focus on
the internet gambling industry is likely because there is a good deal of money
in the internet gambling industry and Lottotron is hoping for just one of these
cases to win – or even to go to the trial stages before being thrown out. The
technology in question could be argued to be open to the public domain and a
basic communications tool that is not patentable by any company. This is the
primary argument of the online casinos in question.
The case really brings up the a key problem with where internet communications
are headed. RTG powered online casinos are being sued by a US based company, but
jurisdictionally, none of the companies being sued actually have businesses
running out of the US, so how will any ruling be formally enforced? This is the
same issue that 1st Technology ran into in a similar patent dispute with the
online poker site Bodog. |
