Kentucky Case Lowdown
The Kentucky Supreme Court must be getting a bit of déjà vu this week as the
online casino domain name case makes a reappearance in the courts thanks to the
decision by one key gambling group to step forward and name itself specifically
in the case. The lowdown on the situation has the Kentucky State Supreme Court
now reconsidering the previous ruling that pretty much halted the case because
of a lack of defendant. The SC noted that it was inappropriate for the iMEGA
advocacy organization to be fully handling all of the defense work without any
of the actual allegedly injured parties stepping forward and naming themselves
in the case. iMEGA asserted the company’s relevancy, but was unable to convince
the SC of this, and thus the case was fully halted and a deadline was issued by
the court for one of the threatened domain names to step forward and name
themselves.
The case is actually looking pretty strong now that an online casino gambling
group has stepped forward. Previously in the ruling the Kentucky Supreme Court
judges acknowledged that iMEGA presented "numerous and compelling arguments" – a
part of the previous judgment that gives the online casinos facing potential
domain name seizure a slice of hope that the SC will actual side with the domain
names rather than the state’s case. Part of the anticipation of a positive
ruling for the sites is also born out of the fact that the SC left the case very
accessible – like it wanted the case to come back for a ruling.
The key obstacle to ending this ridiculous case between 141 online casino domain
names and the state of Kentucky has now been overcome, Yatahay Limited stepped
forward and identified itself on behalf of all of the domain names threatened by
the Kentucky State actions. |
