Denmark's Enforcement
Denmark’s Supreme Court has made a controversial ruling this month that has
severely affected an Danish online poker player and has the ability to also have
some other Danish players thinking twice about funnelling poker winnings into
the country. The Supreme Court ruling upholds a long-standing and old Danish
policy that forbids Danes from making a living from the gambling industry. The
industry is barely legal in the country as it is, with online casinos a key
target for the government, and now there are layers to the situation that could
really affect other internet poker players living in Denmark.
The brunt of the legislation and enforcement lies in the fact that Danish law
specifies that Danes cannot solely support themselves from the gambling
industry. For professional internet poker players this is a big problem because
poker is certainly their job and there is little time for full-time work in
addition to a full line-up of online poker tournaments occurring all over the
world. The other side of the situation though has lawyers for the Danish man
forced to forfeit nearly 200,000 Kroner arguing that the servers for the online
casino poker sites are located outside of Denmark and therefore out of the
Danish government’s jurisdiction.
The courts though refuted that claim by noting that the personal computers are
located within the country and therefore constraint to all Danish laws. In this
case, the Supreme Court ruled that all foreign wins at the online casinos and
poker sites are subject to the Danish laws. This is the current situation at
hand, but the European Commission is actively working with the government to
institute new and more inclusive Danish gambling laws. |
