Absurdity of Online Casinos Exposed
The United States legal system operates on the concept of legal precedence on
similar cases that have already been adjudicated previously through the US legal
system. Cases in other states and court cases at the federal level are all
grounds for legal precedence and judges throughout the US look at previous
rulings when making a new ruling on the same issue. For the fairly new online
casino, there really isn’t a whole lot of legal precedence on which to rely, so
all of the court cases are very new and extremely important. The Kentucky case
is an example of a court case and ruling that has the potential to set a very
controversial legal precedence for other US states and the international
industry at large. The Kentucky government has asked the courts to approve the
domain name seizure of more than 140 online casinos and related companies.
The state’s case is very bizarre and it’s quite surprising that it has made it
all the way to the Kentucky Supreme Court considering the extremely negative and
dangerous precedence that ruling in favor of the state government would cause.
At this point, unnecessary internet censorship is a huge concern in the Western
world and the position that the US and EU take on internet censorship and online
casino gambling laws will likely have far-reaching consequences outside of the
gaming industry and into every aspect of internet businesses.
The Kentucky SC just conducted a hearing on the controversial seizure case, and
though the Kentucky SC is likely going to rule in favor of the online casino
gambling industry, analysts are still worried about a judgment in the other
direction. If the SC rules in favor of the state, and allows the Kentucky
government to seize domain names registered and operating out of foreign
countries, it sets the dangerous precedence that other countries, like China,
can do the same with controversial sites. |
