Gambler's Charges
The recent case out of Kansas City has really caught the attention of the
international online casino gambling industry because of the negative (and
possibly positive) implications that this new development has for the US
internet gambling industry. Nicholas Zicarelli is a US gambler from Kansas City
who has gambled at online casinos from US bank accounts; recently he was put
before a Grand Jury and the courts demanded that he testify against the gambling
and payment processing companies that he used to access the chance gambling
sites. Zicarelli invoked his Fifth Amendment rights for his refusal to testify
and his lawyer has noted that the decision was based on his decision to not give
an official testimony that would implicate Zicarelli in criminal activity.
You can be sure that this is not the reaction that the US authorities were
anticipating when they arrested Zicarelli. What’s so shocking about this case is
that Zicarelli could be facing as many as 18 months in jail because the judge
found him in contempt of the court for his decision to refuse to testify.
Zicarelli is just one of the men in this circumstance now as the US authorities
attempt to nail US facing online casinos through the individual US gamblers
rather than just through the payment processing companies.
US Attorney Assistant Paul Becker has outlined the case in black and white, even
though there are certainly shades of gray in the middle. Becker surmises that
Zicarelli is refusing to testify as a way to protect the online casinos and his
bookmaker rather than for reasons of possible further prosecution for illegal
criminal gambling activity. Becker has noted that the jury has the right to hear
evidence about violations of US laws, and Zicarelli is clearly choosing to
withhold that evidence. Becker is creating a fast list of enemies within the
online gambling industry because of these recent actions and jail sentences. |
