Online Casinos Still an Issue in Kentucky
The online casino industry fervor and media attention that was lavished on the
Kentucky domain name seizure case has waned a bit over the past couple of
months. The state government attempted to force foreign online casinos to comply
with Kentucky regulations concerning internet gambling with the threat of domain
name seizure. These threats sparked international controversy last November and
have culminated in a series of appeals and court appearances where the
Interactive Media Entertainment and Gaming Association (iMEGA) has appealed the
case all the way to the Kentucky Supreme Court.
The Kentucky State government is still adamant that the online casino domain
name seizure attempts are valid by state law because the gambling domain name
could be considered a gambling device and thus are subject to seizure by an
out-dated Kentucky law. The state’s motivations for attempting to seize the
domain names are wholly related to protecting the state horserace betting market
from competition and as a way to force the online casinos not in compliance to
pay huge fines – which means more money and a lot of control for the state
government.
iMEGA has been integral in standing up for the foreign online casinos effected
by this ridiculous attempt to over extend authority. Although some speculated
that the Kentucky Supreme Court would not actually accept the case, the 50-page
brief was reviewed by the SC justices and a court date of June 1st was issued
forth. This is a pretty big feat for the online gambling companies effected –
most analysts theorize that there is no way that the SC justices will side with
the State on this case because of the far-reaching implications this has into
international cyber protection and control. |
