You Shouldn't Play There

Gambling throughout the United States seems to be getting just a little bit harder every day. The UIGEA is the only piece of federal legislation that addresses online casino gambling in the US – and this legislation specifically makes it illegal for the offshore gambling companies to operate in the US market. There is no specific federal legislation making gambling at the online casinos or internet poker sites illegal. Individual states though have taken on the issue in their own rights – and states have even gone to some pretty extreme measures in efforts to protect land gambling interests in the state. Washington State is the biggest offender in the US – the government has legislation in place that makes internet poker gambling a Class C felony offence. That’s a pretty serious offense and although many in the online gambling industry have taken the issue through the courts it looks like the only possible resolution is at the State Supreme Court level.


The PPA has supported efforts over the past year by Lee Rousso to bring the issue of illegal online casino poker gambling to the courts. The validity of the felony law was upheld in the first courts and now, in yet another defeat for the PPA and the supporters of a regulated and licensed online casino poker gambling industry, the Court of Appeals has also upheld the ruling that internet poker is a felony offence. According to supporters, the only place this can now go is to the State Supreme Courts – and that is only if the Supreme Court decides to take the case. Rousso has publicly noted that he believes that there is a strong chance that the SC will, in fact, take the case.


A problem that Rousso has faced through this battle to reclassify online casino poker gambling is the fact that so few of the politicians are even informed about the state’s stance on internet poker – this means that the PPA and poker supporters are forced to educate the politicians while lobbying for change.
