Fast Approaching D-Day
The United States has the ability to really reach a milestone moment next month
as the iMEGA case against the government is ruled on by the 3rd Circuit court of
Appeals. iMEGA is a US-based organization that takes into consideration the
rights and wishes of the online casino gambling and interactive gaming
industries. iMEGA has been pushing a case through the US courts for several
years now in an effort to have the UIGEA declared unconstitutional. Although the
case has lost at the lower courts, the lower courts have always ruled that iMEGA
does have some merit in the case. The organization has the support of the
offshore online casino gambling industry as it attempts to repeal the
controversial ban that is costing the US government respect and money each and
every year.
The UGIEA goes against WTO policies and has angered the European Union over the
past more than two years because it is a protectionist piece of legislation that
has been arbitrarily upheld by the US Department of Justice. The iMEGA case has
finally made it through to a pretty high court and the judge in the case has
announced that he will announce his decision on July 6, 2009. This date could be
a very important milestone in for the online casino gambling industry if iMEGA
is able to win.
The lawyers representing the case are, naturally, a bit on edge about the
reading of the verdict. There are a few things that are still up in the air at
this point –although both sides have already submitted a brief on their
arguments the judge can still request to orally hear both sides present their
argument. There is no telling until 10 days out if this judge is going to rule
from the briefs, or request oral arguments. |
