Betting Companies Have Rights
The lucrative online casino gambling industry has a tough road in some aspects
–there seems to always be someone looking to take a piece out of the gambling
groups. Internet gamblers themselves are often the culprit, but in the recent
cases, the sports organizations in Europe are really starting to make strong
trademark assertions from the land and online bookmakers. The latest case to
come to a head in Belgium actually asserted the rights of the bookmakers –a
court decision that only a few in the industry predicted. Traditionally, the
court system is pretty tough on the online casinos and betting sites that appear
before the courts because of the reputation of the industry as well as the large
money backing land and internet gambling. In Belgium however, several sporting
clubs just lost a trademark case against several bookmakers.
Several sports organizations all over Europe have sued land and online casino
bookmakers for the use of the organization’s trademark in betting matters. The
Belgian case has really hit the headlines and the courts denied that the
bookmakers owed any money to the sports organizations because there is no direct
link from the use of the organization’s trademark. Basically, the bookmaking
industry is not “trading” on the names of these sports organizations, but rather
running alongside these groups with no choice but to use their name and likeness
to conduct business.
It is assumed that the result of this case will bode well for other online
casinos and internet bookies facing court dates in France and other European
countries. There is hope that the Belgian decision will set case precedence for
these other pending cases. |
