A Decisive Decision Coming
The State of Kentucky has made headlines over the past eight months because of
the state government’s efforts to not only block online casino gambling in the
state, but to force internet gambling companies that had operated in the state
to pay fines and face domain name confiscation if they did not comply with the
Kentucky State orders. The case has really made headlines not just because of
the online caisno gambling element, but because of the widespread negative
implications that allowing this would mean for the rest of the world. The
Kentucky State government is seeking permission to confiscate internationally
registered domain names just because they conflict with the state legislation.
iMEGA has fought against this case the entire way and appeal the initial ruling
(which the lowest court ruled in favor of the state and against the rights of
the online casinos) and has taken it all the way through the appeals process.
The case now stands before the Kentucky Supreme Court and a decision is expected
in the very near future. There are a couple of possible outcomes, the SC could
rule to uphold the ruling of the Appeals Court, which stands behind the rights
of the online casinos and rules in favor of iMEGA’s case, or the SC could
overturn the previous ruling and that would cause some serious upheaval if the
state wins the case.
The only third option is that the SC asks for more information from both sides
before making a ruling. Both sides have already entered their argument, iMEGA on
behalf of the online casinos and the industry as a whole, and the state. There
is no telling at this point which way the SC is leaning, but there is a bit of
expectance that the Kentucky SC will not violate international internet protocol
by overturning the previous decision in favor of iMEGA. |
