A Day Away for Online Casinos
The US online casino gambling and betting industry could get a really big break
this week if the top courts in the US decide to uphold the iMEGA appeal that
contends that the UIGEA is flawed and that implementation of the act should be
suspended until the legislation can face an overhaul. iMEGA represents the
interests of the US online casinos and interactive gambling companies and has
taken this case, against the US Department of Justice, all the way to the US 3rd
Circuit Court of Appeals. The judges are set to hear the case on July 7th, 2009
and there is a high level of anxiety now running through the industry as that
day nears and a judgment is coming soon. There is actually a decent chance that
iMEGA can win the case, especially consider the tide of public opinion on the
UIGEA has swung seriously to the negative over the past two years.
Both sides have been forced to submit their briefings and their arguments, a key
point in the iMEGA case is the fact that the UIGEA was passed through without
thorough considerate and it was implemented prematurely. The case goes to say
that as it is written it unfairly targets the online casino gambling industry
without giving clear languages and definitions for the activities that are no
prohibited.
The case is going to be decided by a panel of three judges that will hear the
oral arguments for both sides. Also central to the iMEGA case is the fact that
iMEGA is not arguing for the online casinos, or the legalization of the
industry, but just making a case for the unconstitutionality of the UIGEA and
the fact that the UIGEA is just straight-out flawed. Complete defective. iMEGA
is banking on the three judges reading through the legislation and agreeing that
there are some egregious flaws in the legislation. |
