Caution Needed for the Online Casinos
The internet gambling industry has a lot of foes –and in some cases the foes are
much more indirect than one would suppose. In addition to the interest groups

industry. Forums are an amazing source of information and help for the internet
gambling industry, they are also a place where online casino gamblers are able
to express their own opinions. The recent Betfair libel case in Ireland
showcases the fact that forum owners need to be on alert. Although the EU has
legislation in place protect e-commerce and e-organizations from the third-party
content on their sites, those laws are only partly applicable to the internet
gambling industry.
The Betfair case seems like it has finally turned for the positive for Betfair
with the Irish High Court accepting the online casino betting and gambling
group’s claim that its internet gambling forums were protected by the European
E-Commerce Directive that was enacted in 2001 for the protection of internet
based companies. The law very specifically protects companies from the third
party opinions on the site.
In the Betfair online casino gambling case, this means that the libelous
comments made on the Betfair forums about Ellen Martin and Seamus Mulvaney are
not attributable to the gaming company itself. The libelous statements are owned
by the person who posted them on the forum boards. Betfair, although the company
won the case has learned an important lesson about monitoring the forum –legal
battles are pricey! |
