The Pennsylvania Case
The internet poker gambling situation in the US is changing rapidly on a week to
week basis these days. With the current economic recession the individual state
governments are looking at internet poker as a way to raise state funds. Online
casinos are federally prohibited but there has been a lot of speculation about
whether these rules prohibit the internet poker sites as well. One of the
deciding factors for the internet poker industry comes down to whether the game
is lumped in the with the online casino gambling sites – essentially the skill
versus chance debate. There has been some development on the issues lately and
the Pennsylvania courts have sided with the poker industry naming it a game of
skill.
The Poker Players Alliance is working actively in the United States to secure
the right to gambling at the online poker sites. The online casinos are
definitely banned at the federal level, and although the PPA does support
legislation to repeal the ban, the organization is also actively working to
alter the mindset with which state governments are approaching the game of
poker. Three states have already ruled that poker is a game of skill, and
therefore legal in its online form.
John Pappas, leader of the PPA, observed, "Recent rulings in Pennsylvania, South
Carolina, Kentucky and Colorado all affirmed that poker is a game of skill.” The
newest case though is taking place in the California courts because the
government seized online poker funds that were processing through the Account
Services company. Account Services is actively fighting to have the seized funds
immediately released. |
