A Brief Submitted
The Poker Players Alliance (PPA) has been working hard in support of the online
casino poker payment processors that were negatively affected by the US’s recent
seizure and freezing of player accounts. The PPA is a US based organization that
is actively working to push through new US legislation that would legalize and
regulate foreign and offshore online casinos and create and open and fair US
internet gambling industry. In addition to attempting to repeal the UIGEA
through lobbying and education, the PPA actively works to support any and all
efforts in US states to further the rights of the internet poker gambling
industry. Last week the PPA filed amicus curiae as a way to work with the courts
on the seizure case and literally, act as a “friend of the court.” California is
one of the most progressive of the US states and has actually actively been
working toward legalizing a state-wide internet poker industry.
The Amicus Brief Motion has been filed by the PPA so that the Association can
use its vast resources and culled research to act in an advisory capacity to the
courts on an issue that is fairly new. The court cases and debate surrounding
the online casino gambling industry has only really been a major part of the US
judicial system for about two years. The PPA’s brief informs the court that the
US Attorney’s Office illegally seized the gambling related funds in question.
Further, the brief suggests that the court restore the seized funds to the
online casino poker gamblers who are really being affected by this case. One of
the key facts that will likely work in favor of the Account Services payment
processor is the fact that several other state courts have ruled that poker is a
game of skill and not subject to the same federal restrictions as the internet
casinos. |
