A Turning Point
The online casino poker gambling community in the United States is welcoming the
latest court decision out of Pennsylvania – it marks a turning point in the way
that the US government classifies the game of poker. Thus far, several US State
courts have ruled that poker gambling – whether via the land or online casinos,
was primarily a game of chance and therefore subject to the legislation and
regulation associated with gambling. Pennsylvania Judge Thomas A. James Jr.
though ruled that the game of Texas Hold’em in particular is a game of skill
more so than luck – a welcomed ruling considering to men were facing illegal
poker gambling charges in the state.
Countries all over the world have been forced to make this ruling in recent
years as online casinos and internet poker spread heavily in the global market.
Many poker supporters argue that regulations and restrictions that lump poker
and casino gambling into the same category are unfair. Apparently, Judge James
Jr. agreed that the game is skill based though and this means that the US court
system has a powerful legal precedent in place now that could really positively
affect the rest of the US states as they pass judgments and legislation related
to the control of poker gambling.
Naturally, the Poker Players Alliance (PPA) is thrilled with this latest ruling.
The PPA’s main purpose right now centers on legalize online casino poker
gambling in the United States and one of the PPA’s largest battles thus far was
gaining the recognition of poker as a skill game. The presiding Judge found that
because poker is a strategy based game and there are clearly skilled players
versus bad poker players (and indeed poker pros who are highly skilled at the
game) that these factors were indicative of a game ruled predominately by skill. |
