What this means for the Obama administration is that this situation is a
veritable time-bomb right now that needs a resolution lest the US face more WTO
sanctions. The WTO has continually and outright requested that the US government
halt the enforcement of the UIGEA because it contradicts the US’ trade
commitments in the GATS treaty. Despite the previous WTO ruling that the US
online casino gambling actions were against the WTO trade agreements, the Bush
administration whole-heartedly continued to prosecute and fine internet gambling
companies that operated in the US market both before and after the UIGEA came
into effect.
With all of this history over the past two years – the US’s habitual decision to
operate in a vacuum of protectionist policies when it comes to online caisno
gambling policies, it’s no wonder that this situation is mere moments away from
landing back in the WTO courts.
It leaves those in the online casino gambling industry to wonder if there is any
hope. Will the Obama administration allow this case to make it to the WTO, or
instead will new USTR begin negotiations with other countries about the US’s
enforcement policies regarding foreign online casinos? President Obama has so
much on his hands right now because of the state of the US economy but the
European Commission is not willing to table this issue much longer if the
reports are correct. The only real option is for the negotiations to once again
resume…really though, the cleanest way to end all of this headache would be for
the new administration to make the UIGEA and its support regulations a priority.
Once those issues are resolved and clarified some of these other problems with
the European Commission and the Antiguan government will likely resolve
themselves after that point. |
