Battling in the Courts
Just last month it seemed as though an end was in sight for the online casino
gambling industry in regards to some of the ridiculous requests and actions from
the Kentucky State government. A ruling last month by the Appellate Courts sided
with the registrars and the online casinos by ruling that the state government
had no authority to seize the domain names of gambling sites as a way to
exercise control over those sites. Now though, the issue is, surprisingly,
making its way to the Kentucky Supreme Court.
There are few in the online casino gambling industry, and in the Kentucky
government in fact, that had any inkling that Kentucky Governor Steve Beshear
intended to take this issue to the highest court in the state. Mainly, the doubt
stemmed from the fact that there is no way that the Kentucky government will
ever get the authority, in the long run, to seize the domain names of online
casinos and other sites that allegedly violate certain state laws…the internet
is an global product that cannot solely operate under the control of the US
state governments…that’s a bit presumptuous in fact.
Basically, the governor and those siding with the State of Kentucky over the
online casinos and gambling companies facing domain name seizure are appealing
this last ruling to the Kentucky Supreme Court in hopes that the SC will
overturn the previous ruling and once again allow the state to seize the domain
names of those sites that do not comply with Kentucky’s mandate that exit the
Kentucky online gambling market. |
