We Can Scarcely Hope
The latest industry news indicates that there may be a strong loophole in the
UIGEA and in US online casino gambling policies that clearly allow for
intra-state internet gambling – at least the State of North Carolina believes
this is the case. The North Carolina government has announced plans to permit an
augmented form of online casino gambling in the state. The UIGEA does not allow
for chance games to operate with cash value in the United States, so with that
in mind North Carolina has announced that internet video poker and slots in
exchange for non-cash prizes and bonuses are acceptable.
This is a really fine line though, and one that may be a bit tricky for some
internet cafes to navigate at first because the online casinos are so prevalent
in the US market right now. Cash gambling is still illegal in the State of North
Carolina, and there are a few sticky situations as the state hammers out the
Federal tribal laws and how that will affect the new internet video laws. These
new laws are just that – new. North Carolina is in the process of fully
outlining the way that the online video poker laws will work within the state,
and internet café owners are currently treading lightly as this situation
develops and progresses and receives more clarification at the legislative
level.
One of the big questions though is going to be in determining just where the
illegal nature of online casinos lies. Enforcement of the measures will remain
up to the local authorities as they interpret state law – that’s where the
problems have cropped up in Florida and Texas so far. The local authorities are
raiding cafes and confiscating computers for alleged illegal activity related to
the offshore internet gambling industry. |
