Will Kentucky Ever Win
The answer to that is no. There is only a VERY small likelihood that the lawyers
for the State of Kentucky have any chance of winning a case against the online
casino gambling industry over this situation. The State wants to confiscate 141
internet gambling related domain names on dubious grounds and using a law that
was written before the invention of the internet – to uphold the case would be
absolute absurdity. Now, absurdity is not a far cry away in Kentucky, after all,
this ridiculous case has made it all the way to the Kentucky Supreme Court and
the state is still pressing the case. But to side with the State of Kentucky’s
case would wreak havoc with international internet laws, and international
online casino laws – and that’s something that is simply not acceptable.
The question is though, is it going to happen? Well, although the online
casinos, represented by iMEGA, have the strongest case in the situation, this
case could go all the way to the US Supreme Court. There is no case precedence
in this situation because the online casino gambling industry and the internet
in general is such a new medium. The you have to consider the US government’s
stance on online casino gambling – with the UIGEA still in place and enforcement
measures taking place by the Department of Justice, the US government is not a
fan of internet gambling.
In the end though, even with the UIGEA banning transactions with the online
casinos, nowhere in the legislation does the UIGEA authorize the US to
confiscate international possessions as a viable way of enforcing the US laws-
that would just be taking the situation a bit too far. |
