Sealed Warrants Need Opening
The United States Department of Justice has made headlines yet again because of
the decision to seize gaming funds from a payment processing company that
operated specifically with internet poker sites in the California market. The
DoJ seized the funds under a sealed warrant and they didn’t even have that
warrant at first! At a recent court hearing though the online casino poker
gambling industry is demanding the unsealing of the warrants. The DoJ’s decision
to go after Account Services has really baffled some in the industry in light of
the waning power of the UIGEA. The UIGEA is almost wholly accepted throughout
the US as a flawed and unenforceable piece of legislation that has disrupted the
effective running of US internet gambling trade policies.
But even with the time of death notice soon to be ringing for the UIGEA, the DoJ
chose to attempt perhaps one last enforcement measure before the curtain closes
on this operation. Costigan Media is the company pushing for the unsealing of
the warrants and the judge on the case heard the case from the plaintiffs and is
currently considering the options. Costigan Media contends that there is nothing
in the warrants that the public, and that includes the company affected, the
players, and the online casino gambling industry as a whole, should not hear.
There is an indication that the judge will continue to protect some of the
information contained in the warrant and that will remain confidential. But on
the plus side the online casino gambling industry and the company affected may
get a bit of additional information on just why the DoJ seized the gaming funds
in question. |
