Holding for Congress on Online Casinos
The iMEGA case has likely entered a standstill period that may very well not
show movement for some time now. The online casino gambling related case reached
all the way up to the US Third Court of Appeals this past week and iMEGA, the
Interactive Media Entertainment and Gaming Association, and the US attorneys
faced the judges and answered the questions about the case. iMEGA has publicly
noted on its site that the case did not proceed as expected because of the
judges surprising line of questioning. With the surprising turn of questioning,
iMEGA is no longer fully optimistic about the ruling. One of the key setbacks in
the online casino gambling issue may be a delayed judgment from the court.
Congressman Barney Frank has spearheaded efforts in the US to repeal the UIGEA
in Congress and instead pass new legislation that regulates and licenses
offshore online casinos for access to the US market. Frank’s legislation has
been in the works for several years now and iMEGA has taken the other route,
through the courts to also progress the online casino gambling situation. The
iMEGA decision though now could wait on a decision from Congress in the fall
Congressional session before the iMEGA case judges are willing to announce a
judgment.
The judges on the case have the right to take anywhere between a couple of weeks
to make a decision – or they can wait several months. Congress does not
reconvene until September and iMEGA has speculated that the judges may wait
until after Frank’s legislation has had it’s moment on the floor of
Congressional discussion. If Frank’s legislation passes than the offshore ban on
online casinos, the UIGEA, would be repealed and iMEGA’s would be automatically
resolved. |
