Tightening Online Casino Gambling Restrictions
Gambling in Germany is no easy feat these days in light of the Constitutional
amendment that was passed in January of this year. The German government is
actually in the midst of some serious contention over the controversial new
legislation that specifically targets both foreign and domestic online casinos
and internet gambling groups. Tipp24 AG is at the heart of the argument and the
company actually took the case to the courts. The latest news out of the German
Federal Constitutional Court does not bode well for Tipp24’s legal standing in
the case – the Court ruled that Tipp24’s appeal based on Constitutional rights
and freedoms was not justified.
The online casino gambling industry has gotten very convoluted over the past
several years as the individual countries attempt both form new legislation as
well as reconcile existing laws with the new advances related to the internet
gambling industry. The crux of the issue though, at least for companies
interested in the German market, comes down to the fact that foreign online
casinos are hardest hit by the new legislation. Tipp24 on the other hand still
has some rights in the German market, the new legislation though stripped down
the company’s rights and has now limited the lottery and gaming offerings from
the company in various parts of Germany.
So why did Germany’s top courts side with the German government despite protests
from the online casino gambling industry as well as assertions from the European
Commission that the German legislation violates EU policies and practices. Well,
the statement from the courts noted, "the severe interference with the
constitutionally protected freedom of profession was justified and reasonable in
view of the legislative intent to prohibit and combat gambling addiction.” So,
like a handful of other countries (Sweden to name one other) the government is
pulling the safety argument despite the fact the online casino gambling industry
is safer than ever before and all of the major gambling sites have very specific
technology in place to identify and prevent gambling addictions. |
