Riding the Thin Line
An internet café in the US, and within Utah specifically, is riding the thin
line of legality by operating a sweepstakes within the internet café that some
say just might be breaking state and federal legislation that bans online
casinos from operating for US players. This is the second time that the café has
been shut down and for the same reason – the authorities are unsure of where the
sweepstakes stands in the eyes of the law. The city is arguing that the café is
just on the wrong side of the law and therefore should be shut done for
non-compliance. A Utah lawyer though steadfastly argues that the format of the
sweepstakes was completely legitimate and there was no form of either land or
online casino gambling taking place.
The funny part of the entire situation is that the Hot Spot internet café went
through all of this earlier in the year and the Utah judge asked to rule on the
case ruled that the specifics were out of the jurisdiction of the Utah courts
because of the way that the café is structured. One of the key facts that played
into the case previously was the fact that the café does not offer these
sweepstakes as a temporary promotion but rather an ongoing business offering –
the previous presiding judge indicated that this fact changed the situation and
the ability of the Utah courts to adequately rule on the case.
Hot Spot’s lawyer indicated that representatives from the café have previously
and recently met with city officials to explain the structure of the sweepstakes
game. And while it has to be a bit tiresome for Hot Spot to once again face
closure the authorities do actually have a point – the business does look like a
front for some sort of illegal land/internet online casino gambling. |
