Appeal Specifics to Help Online Casinos
IMEGA has announced that the group (which is an association that works off of
the interests of its members from the online casino gambling industry) filed an
appeal to the Kentucky ruling this week and expects the case to go to the higher
courts. IMEGA’s appeal is based off of the assertion that the Judge Wingate’s
decision in the case violates the guaranteed rights of the constitution for
Americans. The ruling essentially bans any online casinos and internet gambling
sites, both foreign and domestic, from accepting internet gamblers from
Kentucky.
IMEGA contends that the seizure of domain names from online casinos not only
violates the US Constitution, but that the ruling also violates existing laws
within Kentucky as well. The case has been a huge issue in the international
online casino gambling industry and another major concern by the internet
gambling industry and other internet-based industries as well, in fact, is the
fact that the Justice and Kentucky officials simply have no jurisdiction over
internationally registered domain names – internet casino sites or not, there is
no jurisdiction over these sites.
Another hotly contested fact surrounding the case is the obvious fact that the
Kentucky governor is after fattening the state coffers to an extent. The state’s
land betting and gambling industry has taken a serious hit from the online
casinos and the domain name seizure would not only eliminate the competition but
would also bring more money into state coffers via penalties and the such of the
sites that previously operated within the Kentucky market. |
