Drama in Kentucky Never Ends
The online casino gambling industry has been up in arms in the past couple of
weeks as Judge Wingate released a ruling in the domain name seizure case that
largely sides with the Kentucky government. The Kentucky government requested
that the courts approve the seizure of more than 140 domain names of online
casinos suspected of accepting Kentucky gamblers. And while the presiding judge,
Judge Wingate, did not wholly side with the state on the issue, he did authorize
the seizure of any online casino gambling domain name that still accepts
Kentucky players after a given date. That date has been extended to December 3
and even that date is contested by some gambling companies.
Another ongoing issue facing the Kentucky courts is the fact that iMEGA has
gotten involved in the process and the pro-online casino gambling association is
looking to raise just a bit of trouble about the ruling. In fact, although iMEGA
has yet to confirm this, the association has apparently filed a Writ of Mandamus
in an effort to take the issue to the higher courts – the state Supreme Courts
in fact. iMEGA contends that the ruling is flawed and that the confiscation of
domain names from the online casinos and related sites does not take into
account Constitutional rights and the such.
There is really no telling how this case will pan out at this point, all that
can be said is that many of the online casinos are definitely not taking any
chances and they have already begun to geoblock Kentucky residents. The
potential long-term negative effects of this ruling are huge and that is an area
where the Kentucky Supreme Courts will have to tread lightly – if they sanction
the ruling then it means that governments all over the world have the right to
confiscate any domain name they choose that violates the countries laws and
legislation. |
