A Final Warning in Place
Many in the online casinos gambling industry are applauding European
Commissioner Charlie McCreevy for finally making the decision to give final
warnings to two of the ten countries violating the EU Treaty. McCreevy and the
Commission decided that they would end the discussions with Holland and Greece
and instead issue a final warning to the two countries that they must either
alter legislation that currently creates an online casino and betting gambling
monopoly in both countries, or they will face legal action from the European
Court of Justice.
Both of the countries have exclusionary online casinos gambling policies in
place to protect government-run internet gambling and betting companies. Both
countries have restrictions in place that discriminate against foreign
operators. The ECJ has already ruled on the issue citing that restrictions on
online casinos and internet gambling were acceptable as long as the legislation
was proportionate and non-discriminatory. Basically, both countries are allowed
to restrict internet gambling as long as it applies to gambling companies
located within the country as well as foreign operators – this is where the
countries will fail to pass the previous ECJ ruling.
McCreevy and the rest of the commission have spent the past year investing and
in discussions several of the ten countries violating EU policies concerning the
free movement of trade and services between EU member-states. And not surprising
none of the countries in non-compliance have altered their discriminatory online
casino gambling policies despite requests from the Commission. Germany has in
fact recently passed new legislation that came into effect at the beginning of
the year which further violates EU policies.
Now that a final warning has been issued to the Holland and Greece,
non-compliance with the final warning will warrant a case in the ECJ. |
