Winning a Class Action Lawsuit
The Hagens Berman Sobol Shapiro (HBSS) law firm is handling a class action
lawsuit related to the online casinos industry. The class action case was filed
in the Californian Supreme Court and targets the major search engines.
Allegations center on the fact that the search engines like Google and Yahoo!
allowed online casinos to advertise on the search engines for years before
finally passing internal regulations that no longer permitted internet gambling
advertisements through the search engines in the U.S. and the UK.
The lawsuit is designed to take the issue one step past where the federal
government left the search engines. If the case wins the amount requested, the
search engines would pay hundreds of millions in damages to the state of
California that would then go toward social and education programs. Kathrein
notes, "Given the amounts the huge profits we believe they made, we believe
these relatively small forfeiture penalties will not deter them or others in the
future." For that reason the law firm is hoping to use civil litigation as a way
to keep the search engines from exploiting the online casinos industry in the
future.
A key part of the civil case though is the fact that the search engines have yet
to admit that they received money from the online casinos in return for
advertising space. Though most are assuming that the search engines did in fact
make millions off of the online casinos and internet gambling sites, they will
have to prove that fact to win at the California Supreme Court. And for some who
speculate that the search engines may win, HHSS is well known for winning its
high-profile cases.
