Online Casinos Fight Back
Two top online casino betting companies have announced that they will fight back
against the German government’s new legislation that further cements the German
state monopolies. The European Commission has addressed the monopoly problem
with the German government and pushed for Germany to pass new legislation more
in line with European Union trade agreements. But even with the pressure from
the Commission, Germany has chosen to violate trade agreements in favor of state
monopolies that make it illegal for online casinos betting companies like Bwin
Interactive Entertainment and Fluxx AG to operate for German players.
The Commission will now have to continue negotiations with Germany in hopes that
the government will soon pass new legislation, but as that is looking more
hopeless by the day, it is increasingly likely that the issue will have to be
taken to the European Court of Justice. And while there is validity taking the
case to the courts, it could mean that the German government is able to operate
monopolies in the online casinos and betting industries for years until the case
comes to conclusion.
But in the mean time, two prominent online casinos and betting companies, Bwin
and Fluxx have decided to pursue the case in German courts and sue for the right
to access German players. Both of the prominent online betting companies are
using Hambach and Hambach as the German law firm representing their interests.
The online casinos and betting companies are of the position that the German
government has passed protectionist legislation aimed at ensuring that the state
run betting companies have exclusive access to the German betting market. The
law firm remarked the new legislation, "The accord breaches EU law because it
excludes foreign betting companies with EU licenses from the German market."
