Challenging the WA Online Casinos Ban
Just weeks away at this point, the Poker Players Alliance and internet gambling
supporters are gearing up for Lee Rousso’s case against the Washington State
laws that have made online casinos gambling in the state a felony offense.
Rousso has aggressively pursued a court case against the State of Washington for
more than a year at this point and the State has managed to continually postpone
the court hearing. But just a few months ago Rousso attained his first victory
in the situation – a specific date, nailed down and official, for the court case
that will challenge the State’s highly restrictive and protectionist online
casinos gambling laws.
Lee Rousso is a Seattle-based lawyer and a Regional Director for the PPA who is
almost single handedly taking on the state in this case that questions the
Constitutionality of a law that makes online casinos gambling a Class C felony
offense – punishable not only with a fine, but with some serious jail time to
boot. A written statement from Rousso recently noted, “I will continue to work
to change the laws so that Internet poker players can enjoy the Great American
Game from the privacy of their own home. My constitutional challenge to the law
is set for a hearing on April 25, 2008. Assuming I get my day in court
(something the State is desperate to avoid), I think I have a good chance at
winning.”
Most analysts agree that if the courts really do actually hear the case that
Rousso has the potential to force Washington State to reverse what many refer to
as “draconian” online casinos gambling laws. They are largely outdated and
Washington is the only U.S. state to have and enforce such laws related to
internet gambling activities.
And on the more practical side, Rousso acknowledges that even his case faces
some setbacks or he loses the upcoming court case, that he is in it for the long
haul and that he is dedicated to the online casinos poker gambling issues. He
notes in this written statement, "I encourage all my supporters to continue to
fight the good fight. We are going to win this battle. Maybe not today, maybe
not tomorrow, but someday soon." Rousso may not have a huge legal team going
into the upcoming debate but he does have the support of nearly one million
online poker gamblers through the PPA, all supporting his court case.
