Where's the Speedy Trial?
The US government arrested several individuals from the former online casino
betting operation, BetonSports more than a year and a half ago yet no trial date
has been set in the cases. The former CEO of BetonSports, David Carruthers has
been on house arrest for nearly two years and has yet to face trial for his
charges while former founder, Gary Kaplan, similarly is simply awaiting trial.
The US government has an Act in place to ensure that those under arrest and
facing charges in the US are brought to a speedy trail, but that seems to have
fallen a bit amiss now that both men are approaching the two-year mark with no
trial date set and with their appeals left unheard.
The US government passed legislation in 2006 that blocked offshore online
casinos from operating in the US market, and since that point in time the US
government has been seeking out all of the company’s in violation of the
country’s anti-online gambling legislation. BetonSports though not only acted in
violation of the 2006 UGIEA offshore online casino gambling ban, but also faces
other charges related to illegally operating the business and processing
transactions through US banks.
As for the speedy trail issue that has come to light, Kaplan’s lawyers have
appealed to the courts invoking the Speedy Trial Act – asserting that the more
than 17 months in detention violates this act. The courts though have seemingly
ignored the application for release on grounds of the Speedy Trial Act up until
this point. Submitted a bit over a week ago, Kaplan’s lawyers have yet to hear
back from the courts. If Kaplan succeeds in his release from jail Carruthers
could also have a ticket out of house arrest as he has been awaiting trial for
even longer than Kaplan. |
