Seizure of Online Casino Domains Imminent
The industry news has been alight with the threat that the Kentucky government
could seize more than 140 domain names from internet gambling companies in an
effort to enforce compliance with proposed Kentucky legislation. Online casinos
responded to the announcement that the Kentucky government plans to confiscate
international domain names with nonchalance for the most part – few, if any,
gambling sites have registered the domains in the US. At the same time though
the Kentucky government continues to press the Franklin Circuit Court judge for
a ruling in the case. The ruling has been delayed as a result of the sticky
situation surrounding the case.
The fact of the matter is that the Kentucky Governor Beshear may be stretching
his legal limits with this latest legislation that many are purporting is
outright illegal. Governor Beshear’s legislation is aimed at fully stopping
online casinos from accessing Kentucky gamblers by threatening to shut down the
domain names of those site not in compliance with Kentucky’s laws – but that
just seems a bit ludicrous considering the majority of these sites operate
within the international gambling market, not just the Kentucky gambling market.
Circuit Court Judge Thomas Wingate postponed the hearing (scheduled for today)
until tomorrow – which means that the online casinos will have to wait just a
bit longer to find out the fate of the impending legislation. Attorneys and
analysts working on behalf of the online casino gambling industry assert that
even if the Circuit Court judge passes confirms the confiscation of online
casino gambling domain names that the federal courts would never uphold the
ruling. |
