Awarding Huge Patent Lawsuit Damages
Trademark infringement is a serious crime anywhere in the world and is taken
particularly seriously in the online casino gambling industry. Several cases in
recent years have involved US companies seeking patent litigation in the US
courts – the only problem is that many foreign online casinos refuse to step
foot on US soil for fear of arrest for US gambling activities prior to the
enactment of the UIGEA. The international media is now clamoring with the
recently released information that indicates that Party Gaming could face
damages payments of as much as $287 million to WMS Gaming for alleged trademark
infringement.
Party Gaming previously lost the initial trademark infringement court case as a
result of a default judgment because Party Gaming did not even acknowledge the
lawsuit let alone send a representative or lawyer to present information to the
courts. The initial lawsuit payment though was well below the $287 million
requested – a mere $2.67 million in damages. The US Court of Appeals on the
other hand apparently awarded WMS Gaming the requested more than $297 million in
damages according to initial reports from the online caisno gambling industry.
There is no indication about Party Gaming’s reaction to the court’s ruling as
the online casino gambling group has yet to even acknowledge any of the
trademark litigation officially. Party Gaming has really spent efforts over the
past year trying to repair relations with the US government – this announcement
could throw a wrench in those plans. Party Gaming has been working with US
authorities to seek official reprieve from all online casino gambling operations
that Party Gaming administered in the US prior to the UIGEA in late 2006. |
