What it Means for the Online Casinos
The Kentucky courts have sided with the state in the domain name seizure case an
the imminent deadline means that some online casinos will be forced to comply
with the ruling before an appeal can process through the courts again. Franklin
Circuit Court Judge Thomas Wingate ruled that the state has the right to seize
the domain names of any online casino gambling company that continues to operate
within the Kentucky market after 30 days.
All of the domain names that are actually online casino gambling sites must
block the Kentucky players while information and advertisement sites are
apparently exempted from the ban. For internet gambling companies not in
compliance with the ruling as of November 17, 2008, the state will hold a
forfeiture hearing and all of the online casinos will face the official seizure
of their domain name at that time.
Organizations opposing the seizure of the online casino domain names, like iMEGA,
hotly contested the ruling, naturally, and many lawyers and representatives for
the companies involved will likely be present at the forfeiture hearing.
Interestingly enough though, Judge Wingate did lessen the domain seizure to an
extent and allowed companies that have largely advertising sites to present
their case at the forfeiture hearing. The online casinos though are a different
story. Judge Wingate’s decision modified the states original intention and
allows all of the gambling companies to retain their domain names if they comply
with the blocking of Kentucky residents. Only if they fail to block Kentucky
gamblers will they face a domain name seizure.
