PPA Argument Tossed
The Kentucky court decision has caused a big stir in the international online
casino gambling industry – not only with those companies directly affected but
with the organizations representing the interests of the internet gambling
industry. The Poker Players Alliance provided arguments to the court that not
only noted that the seizure of domains was a bit of a far reach for the Kentucky
government, but the PPA’s main message revolved around the argument that poker
gambling is a largely skill based game with only and element of chance in place.
The presiding judge though, Judge Thomas Wingate, did even really consider the
argument and instead dismissed the PPA’s argument right off the bat.
The debate about poker as an extension of the online casino gambling industry or
an independent skill based game is hotly debated all over the world and the
latest case glossed right over the debate and instead noted that the request to
exclude online poker gambling sites was invalid. The justification? Poker may be
largely skill based but there is an element of chance to the game and thus will
be lumped in with the internet casinos and gambling sites facing domain name
seizure.
The Kentucky government specifically bans games with an element – there is no
exceptions in the statute for games that may have higher levels of skill, just
that chance games are banned. This means that internet poker sites are similarly
facing seizure, just like the online casinos, if they do not put blocks in place
to keep Kentucky gamblers from the sites. |
