Ever wonder just what makes some lawyers strive hard to defend the indefensible?
Well in the recent Kentucky legislation that has made headlines around the world
for its attempts to seize the domain names of prominent international online
casinos, the lawyers only get paid if they win. The case is particularly tough
because the domain seizure would not only cross state lines but would also
attempt to seize the domain names of online casino gambling sites licensed
outside of the US. Those in opposition to Kentucky’s solution to the illegal
internet gambling problem have their work cut out for them as they attempt to
instead prove that while online gambling is illegal in the US, the proposed
legislation violates established laws of freedom and trade.
Defense lawyers are looking for any possible and plausible argument that
supports the controversial legislation, and that includes bringing out of the
dredges an archaic law that allows the state to seize illegal gambling devices
when necessary. The law was written long before the Internet was launched and in
the defense argument the lawyers argue that seizure of the domain names is legal
if one considers them an illegal gambling device. It begs the question though –
why should Kentucky have sole control over 141 domain names that also legally
accept online casino gamblers from all over the world?
The fact of the matter is, there is really no way to truly justify the seizure
of the online caisno gambling domain names no matter which way you look at it.
The defense lawyers in the case are attempting to receive a payday and in this
case it means pulling out old laws and attempting to link their pertinence to
