Protesting the Kentucky Confiscation
A hot ticket item up for debate in the US online casino gambling industry is the
Kentucky government’s attempts to confiscate the domain names of some of the top
gambling sites in the world. Kentucky Governor Steve Beshear announced the
proposed legislation just last month and the news of an imminent domain name
seizure was met with instant protestations from the internet gambling industry
and other sectors affected by the domain name seizure. Kentucky’s Franklin
Circuit Court is gearing up to make a ruling in the case and online casinos and
domain name registration companies are waiting with baited breath for the
results.
This case became so controversial that the presiding judge in the case extended
the ruling by several weeks so that lawyers and companies representing both
sides of the issue could submit arguments and briefs to the courts for
consideration in the judgment. The hearing is scheduled for tomorrow and this
ruling could have a potentially very negative affect on the online casinos
facing seizure of their domain names. Information in the case notes that
Beshear’s list of online casinos susceptible to seizure include 141 domain
names.
The courts have temporarily seized these domain names pending the ruling – this
has meant that the online casinos have no idea the fate of their domain until
tomorrow afternoon. Both sides have presented their arguments, and call me
biased, but it seems pretty clear that the Kentucky government is a bit out of
its league with this legislation. The state of Kentucky would have unprecedented
power over the internet casinos and could force the sites to comply with nearly
any ruling with the threat of domain closure as the alternative to
non-compliance. |
