The Swedish government has in place perhaps one of the most lucrative online
casino gambling monopolies in Europe – the nation’s gambling monopoly
effectively controls a huge portion of the internet and land gambling, lottery,
and betting activities. Some of the other countries that have already begun to
comply with the Commission’s requests had restrictive legislation in place, but
were perhaps more amenable to opening their state markets because they did not
have the an elaborate state monopoly in place that was quite as lucrative and
effective at blocking foreign online casinos and gambling sites.
Svenske Spel on the other had is highly lucrative for the Swedish government and
funds the state coffers to a huge extent. The state government has blatantly
objected to the Commission’s requests to open the gambling market to foreign
online casinos and the country’s courts question the applicability of EU trade
principles to the internet gambling industry. To answer some of the huge
questions facing the European online casino gambling industry, the Swedish
Supreme Court sent a handful of highly pertinent questions to the European Court
of Justice for answers.
The questions center on how the EU principles apply to the online casino
gambling market – mainly with the idea of the legality of state monopolies in
mind. And while the ECJ will now have to pass a judgment on the situation and
answer the posed questions, many industry analysts predict that the answer could
be a long time in coming and that the online gambling industry could have to
wait as long as 18 months before the ECJ gives an official answer. |
