The Kentucky case has really caught headlines because of the fact that the
Kentucky government is planning to seize 141 domain names related to online
casino gambling in some way. It doesn’t matter in which country these sites are
registered, the Kentucky government contends that it has the right to confiscate
all 141 domain names. The rationale? Because the internet gambling sites are not
only “illegal gambling devices,” but because they owe the Kentucky government
compensation for revenue lost in the past couple of years due to competition
with the land betting industry by the internet casinos.
Now, many all over the world are watching the Kentucky issue incredulously
because of the dangerous precedence this case would set for the international
internet gambling industry, let alone the impact on the 141 online casinos
facing domain name seizure. Quite frankly, this current situation is right out
of left field in terms of the way that the world’s major (and minor for that
matter) countries have approached banning content from their country or even
specifically attempting to block online casino gambling sites.
The Executive Director at the Internet Commerce Association, Michael Collins,
had some choice words on the issue – he, rightly, pointed out that if this case
passes, what is to stop other countries (like China) from using this as
precedence to seize the domain names of any site (and there are many) that break
the country’s laws? If the Kentucky action passes, there is no telling the way
that other countries could respond to this case. |
