The Laymen's Kentucky Update
You don’t have to be an industry analyst to understand that the proposed
Kentucky action against the foreign online casino domain names is a recipe for
international controversy. The Kentucky courts have not even ruled in the case
yet and already may in the industry and in the media are questioning Kentucky
governor Steve Beshear’s actions. The seizure of foreign online casino gambling
domains appears to go a bit out of the reach of a state government, but all of
the international criticism and debate on the subject hasn’t yet convinced
Governor Beshear and the defense lawyers to drop the case. The only problem is –
most within and outside of the industry consider the position indefensible and a
clear violation of both domestic and international trade laws.
Everyone and their mother seem to have an opinion on the issue – and this is
just in the recent weeks. The industry analysts have opined that the online
casinos and gambling site come out on the wining side of the impending court
ruling. But at the same time, the Kentucky courts might just decide to side with
the state, and in that case the issue would go to the Kentucky Supreme Court and
likely to the federal courts if the online casino gambling sites do not come out
the winner. Although the verdict of the state court is still unclear, the
industry is positive that the case will never stand up to federal scrutiny.
That is good news for the online casinos facing some major issues and financial
challenges in the near future if the state seizes the domain names if the courts
allow the seizure. The internet gambling sites can come out on the other side
but a positive court ruling for the state would mean a large output of money
from the affected gambling sites. |
