The situation in Kentucky should come as no surprise to many – ridiculous
legislation is the norm over the past eight years – but with just days until the
Kentucky Judge passes ruling on the latest legislation, the online casino
gambling industry is waiting with baited breath. The whole situation is a bit
tricky because the online casinos themselves do not believe that the Kentucky
government will actually legally have the right to seize the domain names of
internet gambling companies in the long run if the issue has to go to the
federal courts, but the temporary situation of domain seizure could cost the
internet gambling companies huge chunk of revenue to circumvent.
The Kentucky Governor Steve Beshear has adamantly pushed this newly proposed
legislation as a way to force online casinos out of the Kentucky gambling market
in particular. Once the legislation came to light the internet gambling
companies and domain registrars came out of the woodwork in protestation and
overwhelmed Judge Wingate. Judge Wingate extended the arguments until October 7,
2008 and asked that all parties with a complaint or with a support argument
submit the information before that date.
With the judgment date just days away at this point both sides are straining for
documents and arguments that will hopefully affect the outcome of the ruling.
The defense has a pretty compelling argument if you disregard the fact that the
law was written before the Internet was even an inkling in the minds of the
world. On the flip side, the domain names have international agreements on their
side and they are hoping for the support of the US government if all else fails. |
