Constitutionality Now in Question
The UIGEA is one of the most controversial pieces of legislation in the
international online casino gambling industry at this point – the international
community has raised concerns about the legality of the UIGEA in terms of trade
agreements and organizations within the US have also raised concerns about the
Constitutionality of the legislation. The UIGEA blocks foreign online casinos
from accessing US players by threat of legal action from the Department of
Justice and the US Attorney General. Internationally, the EU delegates are
coming up against a wall in negotiations with the US politicians and members of
Congress. Domestically, the Interactive Media Entertainment &Gaming Association
(iMEGA) has officially announced the company’s appeal to the verdict handed down
a few months past.
iMEGA is a US based association that represents the interests of many domestic
and international companies with an interest in the online casino gambling
industry. iMEGA has firmly opposed the UIGEA and of the implications that the
UIGEA has had on the international online casino gambling industry and has taken
that opposition to the US courts for a ruling on the Constitutionality of the
UIGEA.
The previous court case did not give victory to the UIGEA but did give iMEGA the
legal standing to address the issue in the US Court of Appeals. With the legal
standing firmly in place iMEGA announced the lawsuit, iMEGA vs. Keisler,
continues in the US Court of Appeal 3rd Circuit. Chief on the list of reasons
why iMEGA believes the courts should overturn the online casino gambling ban is
the fact that the Act is entirely vague and unenforceable and in the vagueness
of the wording is causing an unwarranted cooling effect on the US internet
gaming and gambling industries. |
