Carve Outs for Poker
Online casino gambling may still be on the short list of concerns for many
politicians and members of Congress but internet poker is making a strong bid
within the Senate apparently. The controversial UIGEA blocked the transactions
between internet gambling companies and US banking industry. Within the UIGEA
though were specific carve outs for sectors of the internet gambling industry –
particularly Fantasy Football leagues in-state horserace betting. Supporters of
the internet poker gambling industry have spent millions thus far lobbying the
politicians to exclude internet poker from the affects of the online casino
gambling ban and it seems that some politicians have stepped up and are making
the internet poker debate a prominent concern in the US Senate in the coming
weeks.
Those supporting the legalization of online poker in the US argue that the
pastime should be exempted from the regulations of the UIGEA based on the fact
that internet poker is a skill based game and therefore not under the scope of
the UGIEA. The argument of skill based gaming versus a game of chance has been
considered by governments all over the world and most governments have ruled
that while there is a large element of skill in the game of poker, chance plays
a dominant role in the game and thus poker is under the regulations of the
gambling industries.
Senator Robert Menendez’s bill, the Internet Skill Game Licensing and Control
Act has actually made it further than any other piece of legislation related to
online casino and poker gambling. His bill has advanced through the Senate and
will likely go up for vote in the coming weeks. The bill has the firm support of
the Poker Player’s Alliance.
