Skill or Chance Continues
The question of whether poker is a game of skill or chance is ongoing – nearly
every country has been, or will be forced to weigh in on the issue. Denmark is
the latest European nation to grapple with the dilemma in the courts. The issue
affects whether or not poker is lumped in with online casino gambling is
governmental legislation and regulations. Classifying poker as a game of skill
allows the activity to flourish in nations that do not allow forms of internet
gambling. On the other hand though, classification as a game of chance means
that nations with heavy restrictions and bans on land and online casino gambling
do not allow poker gambling either.
The Danish courts have ruled on the issue twice, and a recent appeals to the
last decision will see the issue taken all the way to the Danish Supreme Courts.
Over the past year or so the land and online casino poker gambling industry in
Denmark has slowly began to flourish after a lower court ruled that poker was in
fact a game of skill, and therefore legal to play in poker clubs and other
venues. But just six months ago a higher court in Denmark overruled that
decision and instead ruled that both land and online poker are in fact games of
chance. This ruling has effectively slowed down the development of the Danish
poker gambling industry as players wonder if the pastime is legal or not?
An appeal of the senior Danish Court’s decision takes the issue to the Supreme
Court. And though some speculated that the Supreme Court would not accept the
case, it has in fact decided to pass a ruling for Denmark that will
unequivocally determine which court was right. The ruling could actually also
have an effect on ongoing cases in other countries – the United States, among
other countries, has individuals challenging the decision to classify poker as a
game of chance when land and online casino poker players clearly assert that the
game involves skill more than chance. |
