Will the Banks Participate
The question of whether or not the Netherlands can ban foreign online casinos
gambling companies from accessing the Dutch market could come down to a question
of enforcement. At this point, as the Dutch government preliminarily announces
the new planned legislation, the government plans to rely heavily on the Dutch
banking industry to effectively stop the illegal transactions. The legislation
is similar to U.S. legislation that also seeks to stop transactions at the
financial institution level – but will Dutch banks find the same fault in the
plans that the U.S. banks so openly asserted?
A spokesperson for the Justice Ministry noted that the banks will receive a list
of online casinos gambling companies in violation of Dutch policies, and the
banks will have the responsibility of actually seeking out these transactions
and blocking the transactions. With the current list of banned foreign gambling
sites under 50, the stress on the banking industry may be minimal. But if the
ban were to continue there is no doubting that the government would be forced to
update the list frequently to ensure that new online casinos gambling sites made
it onto the banned list.
There is every likelihood that the Dutch banking industry will have problems
ensuring that every single transaction is blocked because of the nature of
online casinos gambling. U.S. gamblers have found ways around the U.S. ban by
using cash cards, foreign bank accounts in addition to a handful of other
tactics that circumvent the government legislation. At this point, so soon after
the initial announcement, there is no telling if the European Commission will
have the ability to block these new Dutch government efforts before they are
actually implemented and able to discriminate against for online casino gambling
sites.
