The Ladbrokes land and internet gambling group may just end up reentering the
Danish gambling market thanks to a loophole in Danish gambling legislation. The
current legislation in Denmark supports a state-run gambling monopoly – and
recent court cases have blocked foreign online casinos from offering serviced to
Danish players. The latest development could allow companies like Ladbrokes and
other online casino gambling companies to enter the Danish market by offering
online skill games. The argument facing state lawmakers comes down to the fact
that the current gambling legislation only covers games of chance.
The interesting part of the whole situation comes down to the fact that the
challenge to the state gambling laws is from a state-owned television
broadcaster. TV2, the Danish broadcasting company, identified the loophole in
the state gambling legislation and has already begun to offer Danish gamblers
and gamers the chance to receive cash payouts for the games of skill. This
loophole effectively allows online casino gambling companies to enter the Danish
market through skill gaming while the companies wait for the European Commission
to negotiate new internet gambling legislation.
Denmark is one of nearly a dozen EU member states operating a state run land and
online casino gambling monopoly. Although the Commission has begun negotiations
with Danish authorities, the Danish market remains off limits to foreign
internet casinos. The case with TV2 though is giving the Danish authorities a
reason though to reconsider state gambling and gaming regulations – and
Commission will certainly watch the proceedings with care. There is every
possibility that this new loophole will facilitate a fast-growing skill gaming
industry in Denmark. From that point it is only a matter of time before the
Commission or the European Court of Justice forces the liberalization of the
